Аннотация: В учебном пособии рассматривается вопросы закупки продукции организациями, названными в федеральном законе 223-ФЗ «отдельными видами юридических лиц»: госкорпорациями, госкомпаниями, ГУП, МУП, субъектами естественных монополий, организациями, осуществляющими регулируемые виды деятельности в сфере поставки энергетических ресурсов, вПоказать полностьюодоснабжения, отведения, обществами с государственным участием, а также автономными учреждениями. Указанные организации в отличие от «государственного сектора», размещение заказа в котором регулирует Федеральный закон № 44-ФЗ, принято называть «корпоративным сектором». Приводятся основные положения законодательства о закупках, рассматриваются способы закупок в корпоративном секторе, анализируются информационные ресурсы размещения заказов, исследуется порядок подготовки закупочного процесса в том числе обоснования НМЦД и формирование лотов, приводятся правила подготовки торгов и особенности различных форм торгов, порядок проведения торгов. Национальный режим в корпоративных закупках с 01.01.2025 установлен одинаковым с контрактной системой. Рассматриваются правила применения «защитных» мер национального режима. Пособие предназначено для использования в обучении специалистов по организации закупок, членов комиссий организаций корпоративного сектора, размещающих заказы в соответствии с Федеральным законом № 223-ФЗ. The textbook discusses the procurement of products by organizations referred to in Federal Law No. 223-FZ as “certain types of legal entities”: state corporations, state-owned companies, state-owned unitary enterprises, municipal unitary enterprises, subjects of natural monopolies, organizations engaged in regulated activities in the field of energy supply, water supply, and wastewater treatment, public joint-stock companies, and autonomous institutions. These organizations are commonly referred to as the “corporate sector” in contrast to the “public sector,” which is regulated by Federal Law No. 44-FZ. The main provisions of the procurement legislation are presented, the methods of procurement in the corporate sector are considered, the information resources for placing orders are analyzed, the procedure for preparing the procurement process, including the justification of NMCD and the formation of lots, is studied, the rules for preparing tenders and the features of various forms of tenders, and the procedure for conducting tenders are presented. The national regime in corporate procurement has been established as the same as the contract system as of January 1, 2025. The rules for applying the "protective" measures of the national regime are considered. The manual is intended for use in training procurement specialists, members of corporate sector organizations' commissions that place orders in accordance with Federal Law No. 223-FZ. It was created using the reference legal systems "ConsultantPlus", "Garant", and "Ekonom-Expert".
