Аннотация: Using the example of the establishment at the regional level of administrative responsibility for violations of restrictions on the stay of citizens in the forests in order to ensure fire safety, introduced by the state authorities of the constituent entities of the Russian Federation or local authorities, the question of the criteПоказать полностьюria for solving this problem is investigated. The unjustified spread of a formal approach, a narrow- normative understanding of law leads to violations of human rights, when the humanistic idea is distorted: “not a person for the law, but a law for a person.” The use of the requirement of constitutionality and the criterion “human dimension of law” when solving the indicated problems, allows us to put a person with his rights and freedoms at the forefront. This problem is considered through the prism of the current Russian legislation and modern Russian judicial practice.
